The primary federal regulatory body oversight agency for the nationwide tribal gaming sector is currently unable to enforce federal law or approve critical business operations due to an ongoing vacancy at its highest level.

Under federal law, core enforcement and administrative powers for the National Indian Gaming Commission (NIGC) are vested strictly in its chairperson. However, the post has remained vacant since former acting chairperson Sharon Avery’s term expired on January 12. Without a appointed leader, the three-member commission cannot issue legal citations, force emergency closures of unsafe facilities, approve new tribal gaming ordinances, or certify management agreements between tribes and outside casino operators.

The administrative paralysis arrives as tribal gaming reaches record-breaking scale, bringing in $46 billion in 2025 across 545 facilities operated by 250 tribal governments. Revenue generated by these facilities funds essential local government services, including healthcare, housing, and education on tribal lands.

The leadership void is directly impacting tribal operations. For example, the Iowa Tribe of Oklahoma opened a new Harrah’s-branded casino in April, but because the NIGC cannot approve its management contract, the tribe’s small administrative staff has been forced to manage the 175,000-square-foot facility itself rather than handing over daily operations to Harrah’s.

Industry leaders and legal experts warn that the lack of federal oversight creates regulatory uncertainty, risks slowing economic growth, and leaves tribes vulnerable amid the rise of competing unregulated online prediction markets. The White House has acknowledged the commission’s importance but has not provided a timeline for nominating a new chairperson.
